Technological advances in the workplace are creating legal challenges for employers. The use of the Internet, e-mail, handheld computers and camera cell phones by employees who spend their day e-mailing, instant messaging, test messaging, and blogging has expanded while at the same time, litigation over the inappropriate use of these technological devices and the advances has also increased. This presentation will focus on the effective us of electronic communication policies to address these technological advances and the laws implicated by employers who use monitoring to combat the potential risks created by these technological advances. The presentation will also highlight emerging issues involving electronic discovery in litigation and the dangers of not having appropriate electronic document retention safeguards in place before a lawsuit is filed.
